Terms of service
Last updated: November 1, 2026
This is a translation of the Spanish version, which governs in case of any discrepancy.
These terms govern the use of Expedientes, the matter management service offered by Expedientes SpA, RUT (Chilean tax ID) 78.537.143-7, domiciled in Rancagua, Chile («Expedientes», «we»). By creating an account you accept them. If you do not agree with any of them, do not use the service.
1. What the service is
Expedientes is a platform for professionals who work on assignment —lawyers, architects, accountants, brokers, consultants and others— to organize the information of each client: their matters, documents, notes, people involved and critical dates.
Expedientes is not an accounting or tax system, does not handle court or administrative proceedings, does not impose workflows, and does not provide legal or compliance advice. It helps you organize your information; responsibility for your professional work remains yours.
2. Who can sign up
To create an account you must be over 18 and have legal capacity to contract. If you create it for a company or a firm, you represent that you have authority to bind it, and these terms apply to it.
The service is designed for professional work. If you contract as a consumer, or as a micro or small business under Law 20.416, you also have the rights that Law 19.496 grants you, and nothing in these terms limits them.
3. The account
To use the service you create an account with your email and a password. The account is the unit that contracts and pays: a solo professional is an account with one member; a company or a firm is an account with several.
Whoever creates the account is its owner. The owner can invite other people, give them a role —Owner (Titular), Management (Gestión), Collaboration (Colaboración), Read-only (Lectura), or roles the account itself defines— and remove them. What each member sees and can do depends on that role, and the owner is responsible for how their team uses the account.
You are responsible for keeping your password secret and for letting us know through the contact form (in Spanish) if you suspect someone else signed in with it. You can close your open sessions from the application.
4. Price and payment
The service is paid in advance, at the price of the plan you choose when you sign up. The price is set in Chilean pesos, VAT (IVA) included, and includes the plan's storage space and limits; we do not charge per user. Current prices are on the pricing page and in your account.
The first 14 days are free. When you set up the account, a welcome period begins with no charge and no card, so you can try the service before signing up. When it ends, you need to choose a plan to keep using it.
You can pay in two ways:
- Month to month, by card. You register your card once and it is charged every month, in advance, on the same day your plan started, in your account's time zone; if that day does not exist in a month, on the last day of that month. If you still have days already covered, the first charge is when they end. If a charge cannot be made, it is retried. This is an automatic renewal: it continues every month until you stop it, and you can stop it at any time from the application.
- In advance, for several months. A single payment for the period you choose, without storing your card and without automatic renewal. When it ends, you renew whenever you want.
Payments are processed by Flow, a Chilean payment provider. Your card details are received by Flow, or by the payment method you choose on its page; we neither receive nor store them.
There is no right of withdrawal. The service starts the moment you pay, and therefore, as Law 19.496 allows for services, the payment cannot be undone because you changed your mind. We also tell you this on the payment screen, before you pay. The 14-day welcome period is there to try the service.
The price you agree to when you sign up stays the same at each renewal. If we change the price of a plan, the change applies to new accounts and to those that do not yet have an agreed price, not to those already paying.
You can change plans at any time, and the new plan takes effect immediately. If you pay month to month, your card is charged the new plan minus what was left of the previous one. If you had months paid in advance, what you did not use is not lost: it turns into time on the new plan, and any months you pay are added from there.
If a period expires without payment, the account keeps working for a 7-day grace period. After that, the account is blocked: no one can work in it until it is paid, but the information is not deleted.
We may offer promotional codes that grant days or months without payment, discounts or additional space. Each code has its own conditions —validity, plans it applies to, how many times it can be used— and each account can use each code only once.
5. Invoicing
For each payment we issue the tax document that corresponds to the billing details you register in your account. You are responsible for those details being correct. The documents remain available in your account.
6. Your information
What you store in Expedientes is yours: your clients' data, the matters, the documents and the notes. We keep them to provide you the service and do not use them for any other purpose. We do not sell them, we do not share them with third parties beyond those needed to operate the service, and we do not use them to train artificial intelligence models.
Expedientes does not send your information to artificial intelligence services on its own initiative. Your account can connect its own AI assistant: if it does, what that assistant reads is sent to whoever provides it, on your account's instructions, and your account is responsible for that use (section 7).
The invoices and receipts you issue to your clients and record in Expedientes are also part of your information. Keeping them for the time tax law requires is your responsibility.
You can ask us for an export of your information —documents, notes, clients, matters and the invoices you issue to your clients— at any time, including within 90 days after deleting the account. We prepare it at your request and deliver it to you for download.
Our team does not see the content of your account: our internal tools do not show them your clients, matters, notes or documents, not even to investigate an error. Our team acts on your content only at your request —to recover, with your approval from the application, something you deleted that is no longer in your trash, or to prepare an export— and to delete it when you delete the account, within the period in section 12. Every intervention is logged.
How we process personal data, yours and your clients', is described in the Privacy policy.
7. Processing of your clients' data
With respect to the personal data of your clients and of the other people you store in your account, you are the controller and Expedientes acts as processor, under Law 21.719. This section is the contract the law requires for that processing:
- Subject matter and purpose: storing, organizing and showing you the information of your clients and matters, and nothing else. We do not process it for our own purposes.
- Duration: as long as your account exists, plus the 90-day retention period after it is deleted.
- Data and data subjects: whatever you decide to store —names, contact and identification details, documents, notes and dates— about your clients, the people involved in your matters, and those who deliver documents to you or receive the ones you send.
- Our obligations: to process the data only according to your instructions, which are those you give by using the application or an AI assistant you connect; to keep it confidential; to apply the security measures described in the Privacy policy; to notify you without delay if we suffer a security breach affecting that data, with what you need to meet your own obligations; to help you respond to a client exercising their rights; and, at the end, to hand your information over to you and delete it within the periods in section 12.
- Sub-processors: to operate the service we use the providers named in the Privacy policy —hosting, email, payments and network—, each bound by contract to protect the data. By accepting these terms you authorize that engagement. If we are going to change or add one, we will notify you by email at least 30 days in advance; if you disagree, you can delete your account before then.
- Your obligations: to have a legal basis for processing your clients' data and to inform them of what the law requires. Expedientes verifies neither.
AI assistants. Your account can allow its members to connect their own AI assistant, so that it reads and adds information in the account on their behalf:
- The feature is off by default. An account owner turns it on and chooses which members can connect an assistant and whether the account accepts only assistants verified by Expedientes or others too. Each authorized member chooses their assistant and, when connecting it, accepts what it will be able to do.
- The assistant sees the same as the person who connected it: clients, matters, notes and documents. If that person allows it, it can also add clients, matters, notes, documents, people and dates. It cannot delete or modify anything that already exists, and the dates it adds remain as suggestions until someone on your team confirms them.
- Your account can keep clients and matters out of the assistants' reach: no assistant receives them. Unless the person grants permission to see full identification details, RUTs, emails and phone numbers reach the assistant partially masked.
- What the assistant reads is sent to whoever provides that assistant, who may process it outside Chile. That provider is chosen by your account, not by Expedientes: it is your provider, not our sub-processor, and Expedientes does not control what it does with that information and cannot retrieve it, not even if a client of yours asks for their data to be deleted. Handing that information over to it, including outside Chile, is your account's decision.
- Before turning the feature on, it is up to you to have the legal basis for that processing, whatever agreement you need with the assistant's provider, and to inform your clients of what the law requires. Expedientes does not verify any of that or advise you on it.
- If an owner turns the feature off or removes an authorization, or if the person disconnects their assistant, access is cut off within a few minutes. We keep a record of each consent and of what each call from an assistant delivered, as described in the Privacy policy.
8. What you delete
What you delete stays 30 days in your account's trash, where anyone with permission can recover it. After 30 days it is no longer visible in the account and no longer counts toward your plan, and it is kept up to 90 more days in a retention from which only our team can recover it, at the owner's request.
«Eliminar definitivamente» (delete permanently), which only the owner can do, deletes immediately and without retention: the key that encrypts the document is destroyed and the content becomes unrecoverable. It is the way to handle an erasure request from a data subject.
9. Acceptable use
By using the service you agree not to:
- store information you have no right to process, or use it for purposes other than those you disclosed to the data subjects;
- store or share content whose possession or distribution is illegal, and in no case child sexual abuse or exploitation material;
- store or share malicious software, or content that infringes the rights of third parties, such as intellectual property rights;
- attempt to access other people's accounts or parts of the service that are not yours;
- interfere with the operation of the service, overload it or attempt to breach its security measures;
- resell or sublicense the service.
Our team does not review the content of accounts. If an authority orders us to, or we receive a well-founded report of illegal content, we may suspend the account and hand over to the authority what the law requires.
If an account breaches these terms, or if its use puts the security of the service or of other accounts at risk, we may suspend it, informing the owner of the reason, until it is resolved. Paying does not lift a suspension for breach.
10. Ownership of the service and license
The Expedientes software, its design, its brand and its documentation belong to us or to those who license them to us. When you sign up we grant you a limited, non-exclusive and non-transferable license, for the duration of your subscription, for you and your team to use the service in your professional activity. We transfer no other rights to you: you may not copy it, modify it, reverse engineer it or build a service of your own from it.
This does not extend to your information, which is yours (section 6). If you give us suggestions or feedback about the service, we may use them to improve it, with no obligation or payment to you, and without that giving you any right over what we do with them.
11. Availability, support and changes to the service
We do what is reasonable to keep the service available and to safeguard your information, including periodic backups. There may be interruptions for maintenance or for causes beyond our control; where possible we announce them in advance. The service is provided «as is», without a guarantee that it is free of errors.
Support is provided through the contact form (in Spanish), on Chilean business days and hours.
The service evolves: we may add, change or remove features. If we are going to remove something you use in a relevant way, we will notify you at least 30 days in advance and, where applicable, tell you how to take with you what you had there.
12. Closing the account
You can stop renewing at any time, from the application, through the same channel you used to sign up: the account keeps working until the end of the paid period and is then blocked. Stopping renewal or changing plans does not give rise to cash refunds: what you paid is used until it ends, or turns into time on the new plan.
Refunds. If there was a wrong charge —a duplicate, or an amount that does not correspond— or you have another reason to ask us to refund a payment, write to us through the contact form (in Spanish). We review it case by case and, where appropriate, refund it through the same method you paid with.
The owner can delete the account from the application. From that moment no one can sign in to it again. Its information —including the invoices and receipts you issued to your clients— is kept for 90 days and then permanently deleted. Within that period you can ask us for an export to take it with you.
We may close an account that has been blocked without payment for 120 days, notifying the owner by email at least 30 days in advance. Closing it is the same as deleting it: its information is kept for 90 days, during which you can ask us for an export, and then permanently deleted.
If we ever stop providing the service, or decide to terminate your account without you having breached these terms, we will notify you at least 30 days in advance, refund what you paid and did not use, and you will have the same 90 days to take your information with you.
13. Liability
You are responsible for meeting the deadlines and obligations of your professional work. Expedientes helps you see them; it does not meet them for you.
We are not liable for what the users of your account do: you decide whom you add and with which role, and it is up to you to make sure they use it properly.
Nor are we liable for what an AI assistant connected to your account does, or for what the provider of that assistant does with your information. What the assistant adds stays in your account like anything else your team adds, and what it reads is received by a provider your account chose.
To the extent permitted by law, we are not liable for indirect damages, loss of profits or loss of opportunities, and our total liability to you, for any cause related to the service, is limited to what you paid us in the 12 months prior to the event giving rise to it. This limit does not apply to damages caused by our willful misconduct or gross negligence, or to those the law does not allow to be limited.
If a third party makes a claim against us over the information you store in your account, over the use you or your team make of the service, including through an AI assistant your account connected, or because you processed your clients' data without the right to do so —including handing it over to the provider of that assistant—, it is up to you to take charge of that claim and of what it costs us.
Neither you nor we are liable for what cannot be fulfilled due to force majeure or acts of God, such as power or internet outages, earthquakes, fires or other disasters, malicious code, or failures in the connection or equipment on your side.
14. Changes to these terms
We may change these terms. If the change is relevant we will notify you by email at least 30 days in advance. If you keep using the service after that date, you accept the new terms; if you disagree, you can close your account before then.
15. General provisions
- Notices. The notices these terms mention are sent to the email of the account owner; keeping it up to date is your responsibility. Yours, through the contact form.
- Assignment. You may not assign your account or these terms to another person without our agreement; changing the account owner from the application is not an assignment. We may assign them to whoever continues the service, for example if the company is sold or reorganized, notifying you.
- If a clause is invalid. If any part of these terms turns out to be void or unenforceable, the rest remains in force.
- No waiver. Not enforcing something in these terms in one case does not mean we waive enforcing it later.
- Entire agreement. These terms and the Privacy policy are everything agreed between you and us about the service, except what you agree separately in writing with our team.
16. Governing law and contact
These terms are governed by the laws of Chile. Any dispute is submitted to the courts of Rancagua, without prejudice to the actions Law 19.496 allows you to bring before other courts.
For any question about these terms write to us through the contact form (in Spanish).
